Do I need a lawyer for impaired driving charges?
Impaired driving is a highly complex and specialized field of law that requires a great deal of experience and knowledge in order to understand and use the different means of defence. Below are a few examples of questions that the lawyer must answer in such cases:
- Can the Crown prove that the person was in care and control of his motor vehicle at the time of the offence?
- Were the devices used in good working condition and maintained in accordance with the man-ufacturer’s manual?
- Were the devices used handled correctly?
- Did the police conduct the tests as soon as practicable?
- Once pulled over, were the police obliged to wait 15 minutes before taking a breath sample?
- Were there violations of the constitution while obtaining samples or observing symptoms?
- Did the police deprive the accused of his or her right to seek a lawyer’s assistance without delay?
- Was the order to collect a breath sample valid?
- Under the circumstances, was the individual detained beyond what is considered an ac-ceptable length of time?
- Did the police have reasonable grounds for suspicion to summon the person to take a breath sample with the approved detection device?
- Did the police have reasonable grounds to conduct the arrest?
- Did the person have a reasonable excuse not to breathe into the breathalyzer?
Those are a few examples of questions that lawyers specializing in this branch of law must ask themselves. Since each case is unique, several other elements may need to be analyzed.

Category 1: Fees for non-complex criminal cases
Several criminal cases fall into this category. In cases where the rules with respect to the disclosure of evidence are followed, the lawyer is generally able to make an informed decision and advise his client in under a month. Therefore, costs with respect to non-complex criminal cases are lower.

How much does an appeal case cost?
Pursuing an appeal is very costly. The bulk of the expense arises from producing the necessary documents for the Court of Appeal to make a decision. Strict rules must be respected or the appeal will be dismissed. In the case of a long trial, having the shorthand notes transcribed and producing the appendices to the legal brief can easily cost several thousand dol-lars, sometimes up to $10 000. How long does it take to obtain justice?
The judicial process can seem endless when a victim is seeking justice and compensation for the harm done. Access to justice and legal aid
In accordance with section 34 of the Code of Professional Conduct of Lawyers: “A lawyer must inform his client without delay when he believes the client qualifies for legal aid.”

Age of consent in Canada
Professor Julie Desrosiers summarizes the situation in her treatise:
- a child under the age of 12 can never consent to sexual activity;
- a child between the ages of 12 and 14 (less a day) may consent, but only with a person with whom they do not share more than two years age difference;
- a child between the ages of 14 and 16 (less a day) may consent, but only with a person with whom they do not share more than five years age difference.
These are examples where even if the plaintiff consents, the law declares them unfit to consent.

Can recourse against my aggressor be prescribed?
In Canada, a criminal charge regarding sexual accusations is imprescriptible. A civil remedy, however, must not be prescribed. Can I appeal the decision and retry my case?

Can I be discharged even if I am guilty of a crime?
Yes. Discharges are given to people who are guilty of a crime. Although they are not an exceptional measure, certain requirements must be met for the judge to make such an order.

Can I be discharged if I am charged with child pornography?

What role does the lawyer who represents a victim of sexual assault play?

What is the difference between a conditional discharge and an absolute discharge?
An absolute discharge has no conditions, whereas a conditional discharge has conditions. For example, with respect to spousal abuse, when the judge grants a discharge, it may impose measures such as community service in order to satisfy public interest. The Criminal Records Act provides that:
6.1 (1) No record of a discharge under section 730 of the Criminal Code that is in the custody of the Commissioner or of any department or agency of the Government of Canada shall be disclosed to any person, nor shall the existence of the record or the fact of the discharge be disclosed to any person, without the prior approval of the Minister, iF
a) more than one year has elapsed since the offender was discharged absolutely; or
(b) more than three years have elapsed since the offender was discharged on the con-ditions prescribed in a probation order.

What other possible recourses exist for a victim of sexual assault?

(1) Apply to the VCI:
The Victims of Crime Initiative (VCI) is a program created by the Government of Quebec. It helps victims of crime obtain a small amount of money as compensation but does not require you to undertake legal action.
In order to be eligible for the VCI, the victim must have suffered physical or psychological injuries as a result of a crime committed in Quebec.

The Crime Victims Assistance Center (CVAC) is dedicated to helping victims overcome the psychological, psychological and social consequences of injury suffered as a result of an assault. This support service is offered to victims who are in criminal process against their aggressor.

(3) To be compensated during a criminal trial:
The judge in a criminal trial can order a person convicted of a crime to provide their victim with financial compensation. With respect to sexual matters, it is uncommon for a court to make this kind of order for the victim at the moment. The purpose of a judge presiding over a criminal hearing is to punish the crime committed, usually by means of a prison sentence, and to make any other order aimed at protecting the victim and the public. These orders are almost never monetary in nature.
(4) Recourse for sexual harassment or sexual misconduct in the workplace:
Several other remedies may be available to victims of sexual harassment or sexual misconduct. As a result, a victim who has suffered sexual harassment at work can be compensated by applying to the Commission des normes, de l’équité, de la santé et de la sécurité du travail.

What are the probabilities of success of a civil claim against my aggressor? -
The probabilities of success differ from one case to the next. Here are several things that can have an impact on the outcome of a case:
(1) The victim’s credibility:
The injured victim must provide overriding evidence, meaning that, his or her version of events is more likely to be true than the other party’s version. Also, they do not have to convince the judge beyond a reasonable doubt.
(2) The aggressor was convicted in a criminal trial:
This factor can have a positive effect on your civil remedy. However, the criminal court’s judgment does not automatically entail the accused’s civil liability.
(3) The victim’s personal injury supported by expert evidence:
Balance of probabilities is not sufficient to demonstrate the aggressor’s civil fault so as to entail their civil liability. There must also have been injury.
When supported by expert evidence, these injuries can increase the case’s credibility and better guide the court to establish an amount based on the damages suffered.
(4) The victim’s patience throughout the process:
In the event of a dispute, a civil suit against the aggressor may take from several months to a year, sometimes even more.
(5) Victim’s reasonable expectations:
We are not in the United States. The amounts granted in the province of Quebec have nothing to do with the amounts allocated in the US.

What do I do if the period for filing my notice of appeal has expired?
In this situation, the lawyer must file a motion to extend the period to file the appeal. Three factors must be met:
(1) Intent to appeal within the prescribed time.
(2) One or more serious and sustainable means of appeal.

Quels sont les trois types de garde d’enfant pour évaluer la pension alimentaire?
Il existe trois types de garde d’enfant différente qui ont tous un impact différent sur la fixation de la pension alimentaire pour votre enfant.
La première est la garde exclusive avec des droits d’accès, ce qui veut dire qu’un parent a l’enfant avec lui la majorité du temps et l’autre parents voit son enfant moins de 20% du temps sur une années. Donc, si votre enfant est avec vous 72 jours sur 365 ou moins, vous avez des droits d’accès et l’autre parent a la garde exclusive.
Le deuxième type de garde est une garde exclusive avec des droits d’accès prolonger. Ici un parent a encore l’enfant la majorité du temps et l’autre à son enfant entre 20 et 40% du temps, soit entre 73 jours au minimum et 145 jours inclusivement.
Le troisième type de garde aux fins de calcul de la pension alimentaire est la garde partagée. Toutefois, détrompez vous une garde partagée de signifie pas nécessairement que vous et votre ex-conjoint/e avez les enfants 50/50 ! Dès qu’un parent a la garde de son enfant 40% du temps, soit 146 sur 365, il s’agit d’une garde partagée.
