R., 2019 QCCA 1010<\/a><\/p>\n<h2 style=\"text-align: justify;\">Where a statement of an accused contains both evidence of bad character and evidence that is unobjectionable, a trial judge has a heavy duty to edit out the prejudicial aspects of the statement, but must also ensure that what remains is meaningful. If it is impossible to appropriately edit the statement, it should not be admitted.<\/h2>\n<p style=\"text-align: justify;\">[27] Il est \u00e9tabli qu\u2019une preuve qui pourrait tendre \u00e0 d\u00e9montrer la mauvaise moralit\u00e9 ou la propension criminelle de l\u2019accus\u00e9 peut \u00eatre jug\u00e9e admissible \u00ab (1) si elle a rapport \u00e0 une autre question litigieuse que la propension ou la moralit\u00e9, et (2) si sa valeur probante l&#8217;emporte sur son effet pr\u00e9judiciable \u00bb[2].<\/p>\n<p style=\"text-align: justify;\">[28] Un juge peut \u00e9carter certains passages pr\u00e9judiciables d\u2019une d\u00e9claration, sans toutefois conclure qu\u2019elle est inadmissible dans son enti\u00e8ret\u00e9. \u00c0 ce sujet, la Cour d\u2019appel de la Colombie-Britannique \u00e9crit dans l&#8217;arr\u00eat R. v. Oseguera :<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">[20] Where a statement of an accused contains both evidence of bad character and evidence that is unobjectionable, a trial judge has a heavy duty to edit out the prejudicial aspects of the statement, but must also ensure that what remains is meaningful. If it is impossible to appropriately edit the statement, it should not be admitted[3].<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">[29] Le jury doit toutefois \u00eatre en mesure de conna\u00eetre le contexte dans lequel un accus\u00e9 fait une d\u00e9claration. Il existe en effet un danger \u00ab qu\u2019en amputant la d\u00e9claration de certains aspects, l\u2019on occulte une partie qui rend compr\u00e9hensibles les r\u00e9ponses d\u2019un accus\u00e9 \u00bb et le contexte dans lequel ces r\u00e9ponses ont \u00e9t\u00e9 fournies. Il s\u2019agit donc \u00ab d\u2019un exercice d\u00e9licat o\u00f9 l\u2019\u00e9quilibre et le bon sens doivent pr\u00e9valoir \u00bb[4].<\/p>\n<p style=\"text-align: justify;\">[30] L&#8217;\u00e9valuation par le juge de la valeur probante et du caract\u00e8re pr\u00e9judiciable d\u2019une preuve \u00ab doit faire l\u2019objet de d\u00e9f\u00e9rence de la part d\u2019une cour d\u2019appel lorsque cette pond\u00e9ration est raisonnable, exempte d\u2019erreurs de principe et n\u2019est pas fond\u00e9e sur une \u00e9valuation d\u00e9faillante de la preuve \u00bb[5].<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Demers-Thibault c.
