R., 2016 QCCA 1937<\/a><\/p>\n<p style=\"text-align: justify;\">[27]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Il faut remonter au 10 juin 1969 pour trouver un arr\u00eat o\u00f9 la Cour d\u2019appel a eu \u00e0 se prononcer sur le sens de l\u2019expression \u00ab\u00a0un autre endroit public\u00a0\u00bb (en anglais, \u00ab\u00a0other public place\u00a0\u00bb). Il s\u2019agit de l\u2019arr\u00eat\u00a0<em>Regina v.<\/em>\u00a0<em>Mailloux<\/em><a href=\"https:\/\/www.canlii.org\/fr\/qc\/qcca\/doc\/2016\/2016qcca1937\/2016qcca1937.html?searchUrlHash=AAAAAQAvImNoZW1pbiBwdWJsaWMiIDIwMTYgcWNjYSBjcmltaW5lbCBpbnRlcmRpY3Rpb24AAAAAAQ&amp;resultIndex=1#_ftn6\" name=\"_ftnref6\">[6]<\/a>, qui portait sur l\u2019interpr\u00e9tation du\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html#art221par4_smooth\">paragraphe 221(4)<\/a>\u00a0du\u00a0<em><a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">Code\u00a0criminel<\/a><\/em>\u00a0de l\u2019\u00e9poque\u00a0:<\/p>\n<p style=\"text-align: justify;\"><!--more--><\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"317\"><strong>221<\/strong>. (4) Quiconque conduit un v\u00e9hicule \u00e0 moteur dans une rue, sur un chemin, une grande route ou dans un autre endroit public, d\u2019une fa\u00e7on dangereuse pour le public, compte tenu de toutes les circonstances, y compris la nature et l\u2019\u00e9tat de cet endroit, l\u2019utilisation qui en est faite ainsi que l\u2019intensit\u00e9 de la circulation alors constatable ou raisonnablement pr\u00e9visible \u00e0 cet endroit, est coupable<\/p>\n<p>&nbsp;<\/p>\n<p>a) d\u2019un acte\u00a0criminel\u00a0et encourt un emprisonnement de deux ans, ou<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>b) d\u2019une infraction punissable sur\u00a0d\u00e9claration sommaire de\u00a0culpabilit\u00e9.<\/td>\n<td width=\"317\"><strong>221<\/strong>. (4) Every one who drives a motor vehicule on a street, road, highway or other public place in a manner that is dangerous to the public, having regard to all the circumstances including the nature, condition and use of such place and the amount of traffic that at the time is or might reasonably be expected to be on such place, is guilty of<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>a) an indictable offense and is liable to imprisonment for two years, or<\/p>\n<p>&nbsp;<\/p>\n<p>b) an offence punishable on summary conviction.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\">[28]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Le juge Montgomery s\u2019exprimant au nom de la Cour a d\u00e9clar\u00e9 ce qui suit\u00a0:<\/p>\n<p style=\"text-align: justify;\"><strong>2<\/strong>\u00a0On the afternoon of 21st April 1968, a Sunday, a number of persons assembled on the parking lot of a shopping centre to participate in or watch a form of automobile racing, sometimes referred to as drag-racing, involving rapid acceleration over a short distance. The Crown endeavoured to prove that one of those who drove in these races was respondent and that his conduct on this occasion constituted dangerous driving within the meaning of\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html#art221par4_smooth\">s. 221(4)<\/a>, which reads as follows:<\/p>\n<p style=\"text-align: justify;\">&#8220;(4) Every one who drives a motor vehicle on a street, road, highway or other public place in a manner that is dangerous to the public, having regard to all the circumstances including the nature, condition and use of such place and the amount of traffic that at the time is or might reasonably be expected to be on such place, is guilty of<\/p>\n<p style=\"text-align: justify;\">&#8220;(<em>a<\/em>) an indictable offence and is liable to imprisonment for two years, or<\/p>\n<p style=\"text-align: justify;\">&#8220;(<em>b<\/em>) an offence punishable on summary conviction.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>3<\/strong>\u00a0The motion for nonsuit was maintained on the ground that the parking lot in question was privately owned and therefore was not a public place within the meaning of this section.<\/p>\n<p style=\"text-align: justify;\"><strong>4<\/strong>\u00a0With all respect for the carefully reasoned opinion of the trial judge, I consider that he erred in relying upon jurisprudence interpreting provincial highway Acts. The constitutional validity of the penal provisions in such Acts has been upheld precisely because they are Acts relating to public highways under provincial jurisdiction. (See the decision of the Supreme Court in\u00a0<em>O&#8217;Grady v.<\/em>\u00a0<em>Sparling<\/em>,\u00a0<a href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/1960\/1960canlii70\/1960canlii70.html\">1960 CanLII 70 (SCC)<\/a>,\u00a0[1960] S.C.R. 804,\u00a033 C.R. 293,\u00a033 W.W.R. 360,\u00a0128 C.C.C. 1,\u00a025 D.L.R. (2d) 145, and particularly the comments of Judson J., at pp. 810-11.) We are here dealing with a charge laid under the\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">Criminal Code<\/a>, and the essence of the offence is the danger to the public. The title to the piece of ground upon which the offence is committed is of secondary importance, and it becomes a question to be decided in each case whether or not the public has sufficient degree of access to the place to make it a public place within the meaning of this section.<\/p>\n<p style=\"text-align: justify;\">[29]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Selon la fin de ce dernier paragraphe, il ressort qu\u2019un endroit est public au sens du\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html#art221par4_smooth\">paragraphe 221(4)<\/a>\u00a0<em><a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">C.cr<\/a><\/em>. selon que le public y a acc\u00e8s d\u2019une fa\u00e7on suffisante pour justifier la qualification d\u2019endroit public, et ce, peu importe le titre de propri\u00e9t\u00e9.<\/p>\n<p style=\"text-align: justify;\">[30]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Cette id\u00e9e a \u00e9t\u00e9 reprise en 2013 par la Cour de justice de l\u2019Ontario dans l\u2019affaire\u00a0<em>R. v.<\/em>\u00a0<em>Dunsford<\/em><a href=\"https:\/\/www.canlii.org\/fr\/qc\/qcca\/doc\/2016\/2016qcca1937\/2016qcca1937.html?searchUrlHash=AAAAAQAvImNoZW1pbiBwdWJsaWMiIDIwMTYgcWNjYSBjcmltaW5lbCBpbnRlcmRpY3Rpb24AAAAAAQ&amp;resultIndex=1#_ftn7\" name=\"_ftnref7\">[7]<\/a>. Le juge Fraser y d\u00e9clare ce qui suit au sujet du\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html#art259par1_smooth\">paragraphe 259(1)<\/a>\u00a0<em><a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">C.cr<\/a><\/em>.\u00a0:<\/p>\n<p style=\"text-align: justify;\"><strong>35\u00a0<\/strong>This reading of the section is intrinsically tied to the sentencing sanction of the driving prohibition. There should be a loss of driving privilege on any place where motor vehicles are normally used, namely roads, streets and highways. But in addition, there is a prohibition covering any place where members of the public will be impacted by a prohibited driver operating a motor vehicle.<\/p>\n<p style=\"text-align: justify;\"><strong>36\u00a0<\/strong>&#8220;Public place&#8221; in this sense is a place where a non-trivial number of the population can be expected to be present and expect to be protected from exposure to prohibited drivers operating motor vehicles.<\/p>\n<p style=\"text-align: justify;\">[31]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Dans la pr\u00e9sente affaire, le juge de premi\u00e8re instance a conclu que, selon la preuve faite devant lui, le stationnement o\u00f9 a \u00e9t\u00e9 arr\u00eat\u00e9 l\u2019appelant \u00e9tait un lieu public au sens du\u00a0<a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html#art259par1_smooth\">paragraphe 259(1)<\/a>\u00a0du\u00a0<em><a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">Code\u00a0criminel<\/a><\/em>. Il s\u2019agit l\u00e0 d\u2019une conclusion tir\u00e9e \u00e0 partir des constatations de fait effectu\u00e9es par le juge. La Cour est d\u2019avis que le juge n\u2019a pas commis d\u2019erreur manifeste et d\u00e9terminante dans cette appr\u00e9ciation de la preuve qui justifierait son intervention \u00e0 cet \u00e9gard.<\/p>\n<p style=\"text-align: justify;\">[32]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0Le stationnement vis\u00e9 est de dimensions appr\u00e9ciables, tel qu\u2019il appert des photos d\u00e9pos\u00e9es. Sa partie avant jouxte un\u00a0chemin publicsur toute sa largeur et elle ne comporte aucun signe ou obstacle qui emp\u00eache un automobiliste ou un pi\u00e9ton de s\u2019y engager ou d\u2019y p\u00e9n\u00e9trer. Le stationnement est \u00e0 la disposition des occupants des 20\u00a0appartements des deux immeubles, des membres de leurs familles, de leurs invit\u00e9s et, plus g\u00e9n\u00e9ralement, de toute personne qui visite un locataire. Ces faits permettaient au juge d\u2019instance de conclure que le public avait un acc\u00e8s suffisant \u00e0 cet endroit pour en faire un lieu public o\u00f9 la s\u00e9curit\u00e9 des personnes pr\u00e9sentes peut \u00eatre menac\u00e9e par un conducteur assujetti \u00e0 une\u00a0interdiction\u00a0de conduire selon le\u00a0<em><a href=\"https:\/\/www.canlii.org\/fr\/ca\/legis\/lois\/lrc-1985-c-c-46\/derniere\/lrc-1985-c-c-46.html\">Code\u00a0criminel<\/a><\/em>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La d\u00e9finition de \u00ab un autre endroit public \u00bb en lien avec la conduite pendant interdiction (259 C.cr.).
