[100] Although a judge presiding a trial enjoys wide discretion in reviewing decisions of this nature made by a case management judge, doing so: “[…] doit être exercé avec prudence, et non pour permettre un appel déguisé à chaque fois qu’un juge d’instance se prononce en vertu de l’article 551.3 du Code criminel en invoquant “l’intérêt de la justice ».[33]
[101] Ultimately, this evidence was of little significance in the overall scheme of things when there was direct evidence of Mr. Boulachanis’ role in the commission of the offence. Even if I had concluded that Stober, J. should have excluded this evidence, it would not have affected my conclusion as to the outcome of the appeal.
